Filing a Civil Process

  • Civil processes have to be filed with the issuing County. If issued in Davidson County, the process needs to be filed at the Davidson County Clerk of Courts office at located at 11O West Center St Lexington NC 27292

  • The clerk or plaintiff will deliver the process to the Davidson County Sheriff's Office along with a $30.00 service fee per person being served. Service fees can be paid in cash, check (no personal checks), or money order made payable to the Davidson County Sheriff's Office.

  • The Davidson County Sheriff's Office will attempt to serve the process.

  • Once service or attempted service is complete, the process is returned to the Clerk's Office of the issuing County.

In-State Service of Processes Fee

  • In-state processes are $30.00 per person to be served.

  • Criminal Subpoena $5.00 fee

  • Magistrate Summon/Complaint In Summary Ejectment  as well as Writ of Possession Real Property will need one (1) self-addressed stamped envelope addressed to each defendant.

Out-of-State Service of Processes Fee

  • Out-of-state processes are $50.00 per person to be served.

  • Items Needed for Service of Process

  • Original process for return of service

  • Copies for the defendant

Captain

Mark Barnes

Captain Mark Barnes began his career in law enforcement in 2004. In 2006 his career path led him to Davidson County Sheriff’s Office where he worked in the Civil Division, then entered the Patrol Division. When 2009 approached, Captain Barnes pursued the Breaking and Entering Task Force for three years. As 2013 approached he was promoted to Detective where he would remain for the next five years before being promoted to Sergeant in the Professional Standards Division. In October 2020, Barnes was promoted to Lieutenant over the Internal Affairs / Professional Standards Division.  In January 2024 Lt. Barnes was promoted to the rank of Captain over the Civil Division where he oversees the Civil Process Division and the Court Bailiffs. Captain Barnes continues serving as a Training Coordinator, General Instructor and currently holds an Advanced Law Enforcement Certification.
